By requesting a quote, making a payment, or using any service from Axious Creative Studio, you confirm that you have read, understood, and agreed to these Terms & Conditions in full. These terms are binding from the moment a project is initiated.

Scope of Services
Axious Creative Studio provides the following services under these Terms:
Custom website design and development
Website hosting (monthly and annual plans)
Point-of-Sale (POS) system setup and support
AI chatbot integration and configuration
E-commerce and client portal development
SEO setup and digital marketing services
Website maintenance plans and add-ons
Services are delivered as described in the agreed project scope or package. Any features or functionality outside the agreed scope will be quoted and billed separately.

Fees & Payment
Website packages require a 50% deposit before work commences. The remaining balance is due before the website goes live.
Hosting — Monthly plan: R100/month, billed on the 28th of each month.
Payment may be made via EFT (Capitec Entrepreneur, Acc No. 248650558, Ref: your website URL) or via the online payment gateway in your client portal.
Accounts overdue by more than 7 days may be suspended without notice.
Accounts overdue by more than 30 days may be permanently terminated and the client's data archived.
All pricing is quoted in South African Rand (ZAR) and is exclusive of VAT where applicable.
Strictly No Refunds
All payments are final and non-refundable under any circumstances. This includes deposits, hosting fees, and add-on payments. Please ensure you are satisfied with your project scope before making any payment.

Revision Policy
All website packages include two (2) rounds of revisions at no additional charge. It is critical that clients supply complete, accurate, and final information before the project begins — revisions caused by incomplete or incorrect information supplied by the client will count toward the included revision rounds.

What counts as a revision?
Changes to text, colours, fonts, or layout after design approval
Adding or removing sections that were not in the original scope
Restructuring pages or navigation after sign-off
Changes resulting from content supplied incorrectly or incompletely by the client
⚠ Have All Your Information Ready Before We Start
To make the most of your included revisions, please have the following ready before the project begins: your logo files (high resolution), brand colours, all text/copy, product or service images, contact details, and any specific design preferences. Changes caused by late-supplied or incorrect content are not exempt from the revision count.

Client Responsibilities
The client agrees to the following responsibilities throughout the project:
Provide all required content — including text, logos, images, and branding assets — within 7 days of project commencement. Delays in content delivery will extend the project timeline accordingly and do not entitle the client to a refund.
Ensure all supplied content is accurate, final, and ready for use. Changes to content after design approval consume revision rounds.
Supply high-resolution images and correctly sized logo files. We are not responsible for poor-quality output resulting from low-resolution assets provided by the client.
Review draft designs and provide consolidated, specific feedback — not multiple separate rounds of small changes.
Respond to design feedback requests within 5 business days. Failure to respond may result in the project being paused and rescheduled.
Ensure that all content supplied does not infringe third-party copyrights, trademarks, or rights. The client indemnifies Axious Creative Studio against any claims arising from client-supplied content.
Keep login credentials for the client portal secure and confidential.

Intellectual Property
Upon receipt of full and final payment, ownership of the custom design and code produced for the client transfers to the client.
This transfer does not include third-party plugins, licensed libraries, stock assets, or any code owned by external parties.
Until full payment is received, Axious Creative Studio retains all intellectual property rights over all work produced.
Axious Creative Studio reserves the right to display completed work in our portfolio, on social media, and in marketing materials, unless the client requests otherwise in writing.
Any branding, frameworks, or tools developed by Axious Creative Studio remain the property of Axious Creative Studio and are licensed (not sold) to the client for use within the scope of the delivered project.

Hosting & Maintenance
Axious Creative Studio provides website hosting with a 99.9% uptime target. We are not liable for outages caused by third-party infrastructure, server providers, or force majeure events.
Website maintenance (content updates, plugin updates, security patches) is available as a paid add-on. Without an active maintenance plan, the client is solely responsible for updates after handover.
We reserve the right to perform scheduled maintenance windows. We will provide reasonable advance notice where possible.
Hosting fees must be paid on time to keep the website live. Suspended websites will be restored once outstanding payments are settled.
Axious Creative Studio is not responsible for data loss resulting from the client's failure to maintain backups, or from circumstances beyond our control.

Project Timeline
Project timelines are estimates and are contingent on the timely delivery of all required content and feedback from the client.
Standard website projects are typically delivered within 7–21 business days from the receipt of deposit and all required content.
Timelines will be extended if the client fails to supply content or respond to feedback within the agreed timeframes.
Rush delivery may be available upon request and will be quoted separately.
Axious Creative Studio is not liable for delays caused by third-party services, external APIs, payment gateways, or hosting providers.

Refund Policy
Strictly No Refunds — All Payments Are Final
No refunds will be issued once a deposit or full payment has been made.
No refunds will be issued for hosting fees, regardless of the reason for cancellation.
No refunds will be issued for add-on services once work has commenced.
If a project is abandoned by the client after work has begun, the deposit is forfeited.
If you are dissatisfied with any aspect of our service, please contact us at design@axiouscreativestudio.co.za or via WhatsApp before initiating any payment dispute. We are committed to resolving concerns fairly.

Limitation of Liability
Axious Creative Studio's total liability to the client under any circumstances shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunity.
We do not guarantee specific search engine rankings, advertising results, or business outcomes from any service we provide.
We are not liable for any damages arising from the client's use of third-party platforms, plugins, or services integrated into the project.

Termination
Either party may terminate a service agreement with 7 days' written notice via the client portal, email, or WhatsApp.
Axious Creative Studio reserves the right to terminate services immediately for non-payment, abusive conduct, or breach of these Terms.
Upon termination of hosting, the client's website data will be preserved for 30 days before permanent deletion. It is the client's responsibility to request an export of their data within this period.
Termination does not entitle the client to a refund of any paid fees.

Privacy & Confidentiality
Axious Creative Studio collects and stores only the personal information necessary to deliver our services. We do not sell or share your personal information with third parties for marketing purposes.
Client data is stored securely and accessed only by authorised staff for the purpose of service delivery.
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project and not to disclose it to third parties without written consent.
By registering on the client portal, you consent to receiving transactional emails related to your account, projects, and invoices. You may opt out of marketing communications at any time.
Our practices are aligned with the Protection of Personal Information Act (POPIA) of South Africa.

Account Security & Client Portal
Your Studio Xonnect client portal account gives you access to sensitive business information including invoices, project files, SEO performance data, and payment functions. We take account security seriously and so should you.
How We Protect Your Account
Token-based authentication: Your login session is secured with a signed JWT (JSON Web Token) — your password is never stored in plain text or sent over the network unencrypted.
Bcrypt password hashing: Passwords are one-way hashed using bcrypt before being stored in our database. Even our staff cannot see your password.
Google OAuth option: You can sign in using your existing Google account, bypassing the need to create or remember a separate password. Google handles authentication on their end.
Secure HTTPS connections: All communication between your browser and our server is encrypted via SSL/TLS. Your credentials and data are never transmitted in plain text.
Access controls: Your account can only access your own data. Admin accounts are strictly separated from client accounts and require separate credentials.
Token expiry & validation: Login tokens expire automatically after a set period. On each session, your token is validated server-side — expired or tampered tokens are rejected immediately.
Password reset via email: Reset links are single-use, time-limited (1 hour), and sent only to the verified email address on your account.
Your Responsibilities
Keep your login credentials confidential. Do not share your password with anyone, including staff members of Axious Creative Studio — we will never ask for your password.
Use a strong, unique password for your portal account. We recommend at least 10 characters including uppercase, lowercase, numbers, and symbols.
If you suspect your account has been compromised, change your password immediately via the portal or use the "Forgot Password" function on the login page, then contact us on WhatsApp at 062 379 0118.
Do not access your portal from shared or public devices without logging out when done.
Notify us immediately if you notice any unauthorized activity, unexpected payments, or unfamiliar changes to your account or project files.
You are responsible for all activity that occurs under your account credentials.
Account Suspension for Security
Axious Creative Studio reserves the right to suspend or lock an account if we detect suspicious activity, multiple failed login attempts, or potential security breaches. We will notify you via email if your account is locked. Legitimate accounts can be unlocked by verifying your identity via email or WhatsApp.

Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall fall within the jurisdiction of the courts of the Western Cape.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
