Terms & Conditions

Axious Creative Studio provides the following services under these Terms:

• Custom website design and development
• Website hosting (monthly and annual plans)
• Point-of-Sale (POS) system setup and support
• AI chatbot integration and configuration
• E-commerce and client portal development
• SEO setup and digital marketing services
• Website maintenance plans and add-ons

Services are delivered as described in the agreed project scope or package. Any features or functionality outside the agreed scope will be quoted and billed separately.

• Website packages require a 50% deposit before work commences. The remaining balance is due before the website goes live.
• Hosting — Monthly plan: R100/month, billed on the 28th of each month.
• Hosting — Annual plan: R850/year, billed annually (saving R350 vs monthly).
• Payment may be made via EFT (Capitec Entrepreneur, Acc No. 2568638997, Ref: your website URL) or by card through the secure Yoco payment link we send you.
• Accounts overdue by more than 7 days may be suspended without notice.
• Accounts overdue by more than 30 days may be permanently terminated and the client's data archived.
• All pricing is quoted in South African Rand (ZAR) and is exclusive of VAT where applicable.

All website packages include two (2) rounds of revisions at no additional charge. It is critical that clients supply complete, accurate, and final information before the project begins — revisions caused by incomplete or incorrect information supplied by the client will count toward the included revision rounds.

The client agrees to the following responsibilities throughout the project:

• Provide all required content — including text, logos, images, and branding assets — within 7 days of project commencement. Delays in content delivery will extend the project timeline accordingly and do not entitle the client to a refund.
• Ensure all supplied content is accurate, final, and ready for use. Changes to content after design approval consume revision rounds.
• Supply high-resolution images and correctly sized logo files. We are not responsible for poor-quality output resulting from low-resolution assets provided by the client.
• Review draft designs and provide consolidated, specific feedback — not multiple separate rounds of small changes.
• Respond to design feedback requests within 5 business days. Failure to respond may result in the project being paused and rescheduled.
• Ensure that all content supplied does not infringe third-party copyrights, trademarks, or rights. The client indemnifies Axious Creative Studio against any claims arising from client-supplied content.
• Keep any logins for your website, domain, hosting or email secure and confidential.

• Upon receipt of full and final payment, ownership of the custom design and code produced for the client transfers to the client.
• This transfer does not include third-party plugins, licensed libraries, stock assets, or any code owned by external parties.
• Until full payment is received, Axious Creative Studio retains all intellectual property rights over all work produced.
• Axious Creative Studio reserves the right to display completed work in our portfolio, on social media, and in marketing materials, unless the client requests otherwise in writing.
• Any branding, frameworks, or tools developed by Axious Creative Studio remain the property of Axious Creative Studio and are licensed (not sold) to the client for use within the scope of the delivered project.

• Axious Creative Studio provides website hosting with a 99.9% uptime target. We are not liable for outages caused by third-party infrastructure, server providers, or force majeure events.
• Content edits after handover are charged at R350 per hour (1-hour minimum), quoted and invoiced before work begins. Website Subscription clients get up to 1 hour of content updates per month included. Security patches to the hosting are covered by the monthly hosting fee.
• We reserve the right to perform scheduled maintenance windows. We will provide reasonable advance notice where possible.
• Hosting fees must be paid on time to keep the website live. Suspended websites will be restored once outstanding payments are settled.
• Axious Creative Studio is not responsible for data loss resulting from the client's failure to maintain backups, or from circumstances beyond our control.

The Website Subscription is separate from our once-off website packages. The client pays to use a website we build and host, instead of buying it outright.

• Fees: a once-off setup fee of R599, then R499 per month, due on the 28th of each month from the second month. No 50% deposit applies.
• Ownership: the client does not own the website, design or code while subscribed. All intellectual property remains with Axious Creative Studio and is licensed to the client for the duration of the subscription.
• Buy-out: after 6 months of paid subscription, the client may buy the website outright for a once-off fee of R2,000. Ownership of the custom design and code then transfers to the client, subject to section 05. Hosting can continue at our standard hosting rate.
• Minimum term: 6 months. After that, the client may cancel with 30 days' written notice.
• On cancellation: if the client cancels without buying the website, the website is taken offline and remains the property of Axious Creative Studio. The client keeps their own content (text, images and logo) and their domain name.
• Included: up to 5 pages, hosting, SSL, domain, WhatsApp button and quote form, on-page SEO and up to 1 hour of content updates per month (unused hours do not roll over). Extra features are quoted separately.
• Late payment: if a monthly payment is more than 2 days overdue, the website may be suspended until the account is settled.

Project timelines are estimates and are contingent on the timely delivery of all required content and feedback from the client.

• Standard website projects are typically delivered within 7–21 business days from the receipt of deposit and all required content.
• Timelines will be extended if the client fails to supply content or respond to feedback within the agreed timeframes.
• Rush delivery may be available upon request and will be quoted separately.
• Axious Creative Studio is not liable for delays caused by third-party services, external APIs, payment gateways, or hosting providers.

If you are dissatisfied with any aspect of our service, please contact us at design@axiouscreativestudio.co.za or via WhatsApp before initiating any payment dispute. We are committed to resolving concerns fairly.

• Axious Creative Studio's total liability to the client under any circumstances shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
• We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business opportunity.
• We do not guarantee specific search engine rankings, advertising results, or business outcomes from any service we provide.
• We are not liable for any damages arising from the client's use of third-party platforms, plugins, or services integrated into the project.

• Either party may terminate a service agreement with 7 days' written notice via email or WhatsApp.
• Axious Creative Studio reserves the right to terminate services immediately for non-payment, abusive conduct, or breach of these Terms.
• Upon termination of hosting, the client's website data will be preserved for 30 days before permanent deletion. It is the client's responsibility to request an export of their data within this period.
• Termination does not entitle the client to a refund of any paid fees.

• Axious Creative Studio collects and stores only the personal information necessary to deliver our services. We do not sell or share your personal information with third parties for marketing purposes.
• Client data is stored securely and accessed only by authorised staff for the purpose of service delivery.
• Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project and not to disclose it to third parties without written consent.
• By engaging our services, you consent to receiving transactional emails and WhatsApp messages about your projects, invoices and hosting. You may opt out of marketing communications at any time.
• Our practices are aligned with the Protection of Personal Information Act (POPIA) of South Africa.

Axious Creative Studio does not provide client login accounts. Project updates, invoices, payment links and support are handled directly by our team over WhatsApp and email.

Your Responsibilities

• Only make payments through a Yoco link sent from our official channels, or by EFT to the banking details on your invoice. If you are unsure whether a message or payment request is genuine, contact us on 062 379 0118 before paying.
• We will never ask for your passwords, one-time PINs or card details.
• Keep any logins you own for your website, domain, hosting or email (for example, the admin dashboard of your website) secure, and do not share them with anyone you do not trust.
• Tell us promptly if your contact details change, so invoices and project updates reach you.
• Notify us immediately if you notice unauthorised changes to your website or any unexpected payment requests in our name.

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall fall within the jurisdiction of the courts of the Western Cape.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
